American Canyon rules on file

Local rules recorded in this project for this jurisdiction. Where a city figure on file is stricter than the state baseline on file, both are shown.

Which rules apply

American Canyon's ADU rules are in Municipal Code Chapter 19.39 (rewritten by Ordinance 2024-04 and amended by Ordinance 2026-04). Its rent and household-size reporting rule is left out of this summary because it may conflict with state law. The chapter defers to state law on unit counts, heights and setbacks, so state rules apply there.

How many units

The number of ADUs and junior ADUs on a single-family lot follows Gov. Code 66323. A main home must exist or be built at the same time. ADUs that qualify under Gov. Code 66323 are subject only to the standards Gov. Code 66321 and 66323 allow.

Size limits

Detached ADU: up to 1,200 sq ft, or the size of an existing permitted accessory structure being converted on a single-family lot; no size limit for a detached ADU on a multifamily lot. Attached ADU: up to 1,200 sq ft (not for conversions under Gov. Code 66323(a)(1) or (a)(3)). Junior ADU: up to 500 sq ft.

Fire sprinklers

Only if the main home has them, and an ADU does not trigger sprinklers in the main home.

Owner occupancy and deed restrictions

No owner occupancy for ADUs. The owner must live in the main home only when a junior ADU has no separate bathroom. No deed restriction except where state law allows it.

Impact fees

ADUs under 750 sq ft and junior ADUs up to 500 sq ft pay no City impact fees. Larger ADUs pay no water and sewer capacity fees, and other impact fees in proportion to the main home.

Multifamily lots

Non-livable space in an existing multifamily building may be converted to ADUs, up to 25% of the existing units, and detached ADUs are allowed up to eight (not more than the existing units).

Fire Hazard Severity Zones

If your lot is in a Fire Hazard Severity Zone, the CAL FIRE Office of the State Fire Marshal says in Information Bulletin 25-004 (issued March 3, 2025): “Fire Hazard Severity Zones (FHSZs) should not restrict the development of Accessory Dwelling Units (ADUs). However, additional building standards may be necessary, including but not limited to California Fire Code Chapter 49 and California Building Code Chapter 7A.” State ADU law does not itself bar an ADU there. A city or county may still apply its building code, including wildfire-resistant construction (Gov. Code 66314(d)(8)); require side and rear setbacks “sufficient for fire and safety” for a unit converted under 66323(a)(1); and decline parking in setbacks on specific fire and life safety findings (66314(d)(10)(B)). It may also consider public safety when it designates where ADUs may be permitted (66314(a)). Sprinklers can't be required in an ADU or JADU if the primary residence doesn't need them (66314(d)(12), 66323(d)). Some cities and counties still apply their own fire-zone limits. Where this summary has one, it is listed with the local rules. This summary does not look up your lot.
