How big can an ADU be in La Quinta?

Maximum size

A new detached ADU may be up to 1,200 sq ft. An attached ADU may be up to 850 sq ft, or 1,000 sq ft with more than one bedroom. A detached ADU built under the state's 800 sq ft rule is limited to 800 sq ft. An efficiency unit must be at least 150 sq ft.

ADU setbacks in La Quinta

Setbacks

New ADUs need no more than 4 ft side and rear setbacks. No setback is needed for existing living area or an accessory structure converted to an ADU, or a rebuild in the same place and size. The zone's front yard setback applies unless it would block an 800 sq ft ADU with 4 ft side and rear setbacks.

Local ADU rules

La Quinta's ADU rules are in Municipal Code Section 9.60.090, last amended by Ordinance No. 618 (December 3, 2024). ADUs are allowed in the RVL, RL, RC, RM, RMH, RH, CR, CP, CC, CN, TC, CO and VC zones, and JADUs in the single-family zones. ADU and JADU permits are reviewed ministerially, without a hearing, and acted on within 60 days of a complete application when the lot already has a home.

ADU types under state law

On a single-family lot: an ADU or JADU inside the home or an existing accessory structure (up to 150 sq ft added for entry and exit), and one new detached ADU up to 800 sq ft with 4 ft side and rear setbacks, which may be combined with a JADU. On multifamily lots: ADUs in non-livable space of existing buildings (at least one, up to 25% of existing units).

Height

A detached ADU may be 16 ft. It may be 18 ft within a half mile walk of a major transit stop or high-quality transit corridor, or on a lot with a multistory multifamily building, plus 2 ft to match the main home's roof pitch. An attached ADU may be 25 ft or the main home's height limit, whichever is lower.

Parking

No more than one space per ADU or per bedroom, whichever is less, which may be tandem on a driveway or in setback areas. No space is needed within a half mile walk of public transit, in a historic district, for an ADU inside the home or an accessory structure, where on-street permits are required but not offered, within one block of a car share vehicle, or when the ADU is filed with a new home or multifamily building. Garage, carport or covered spaces removed for an ADU do not have to be replaced. JADUs need no parking.

Junior ADUs

One JADU per single-family lot, 150 to 500 sq ft, inside the walls of the proposed or existing home, with an efficiency kitchen and its own entrance (plus an interior door if it has no separate bathroom). The City may require a recorded covenant against separate sale. A JADU is not a separate unit for water, sewer or power service. No parking is needed.

Fees, sprinklers and rentals

No impact fees for an ADU under 750 sq ft; ADUs of 750 sq ft or more pay in proportion to the main home's size. Fire sprinklers are not needed if the main home does not need them. ADUs may be rented for more than 30 days but may not be used as short-term vacation rentals, and may not be sold separately except through a qualified nonprofit as state law allows. Lots on septic need county health and regional water board sign-off.

State housing department (HCD) review

On June 24, 2026, HCD found that La Quinta's ADU ordinance (No. 618, adopted December 3, 2024) does not comply with state ADU law on several points: outdated Government Code references, the 50% size cap for attached ADUs without the 800 sq ft exception, the one-ADU-and-one-JADU limit, owner occupancy for every JADU, and missing completeness timelines. HCD gave the City up to 30 days to respond. Confirm the current rules with the City of La Quinta.

Fire Hazard Severity Zones

If your lot is in a Fire Hazard Severity Zone, the CAL FIRE Office of the State Fire Marshal says in Information Bulletin 25-004 (issued March 3, 2025): “Fire Hazard Severity Zones (FHSZs) should not restrict the development of Accessory Dwelling Units (ADUs). However, additional building standards may be necessary, including but not limited to California Fire Code Chapter 49 and California Building Code Chapter 7A.” State ADU law does not itself bar an ADU there. A city or county may still apply its building code, including wildfire-resistant construction (Gov. Code 66314(d)(8)); require side and rear setbacks “sufficient for fire and safety” for a unit converted under 66323(a)(1); and decline parking in setbacks on specific fire and life safety findings (66314(d)(10)(B)). It may also consider public safety when it designates where ADUs may be permitted (66314(a)). Sprinklers can't be required in an ADU or JADU if the primary residence doesn't need them (66314(d)(12), 66323(d)). Some cities and counties still apply their own fire-zone limits. Where this summary has one, it is listed with the local rules. This summary does not look up your lot.
