How big can an ADU be in Needles?

Maximum size

The code sets no size limit for an attached or detached ADU, but it may not be larger than the main home and must meet the zone's setback, building spacing, open space, lot coverage and floor area rules. Under state law (Gov. Code § 66321(b)(2)-(3)), those rules cannot block an 800 sq ft ADU with 4 ft side and rear setbacks, and a size cap cannot be below 850 sq ft (one bedroom or less) or 1,000 sq ft (more than one bedroom). A manufactured home or tiny home ADU may be up to 1,200 sq ft.

ADU setbacks in Needles

Setbacks

State law caps side and rear setbacks for a new ADU at 4 ft; the City's 5 ft rule for detached ADUs is held back (see below). An ADU above a garage needs no more than 4 ft. No setback is needed to convert a lawfully built garage or accessory structure. If the ADU is built before the main home, a 26 ft front setback applies. A detached ADU must be at least 3 ft from the main home and any detached accessory building.

What we have for this place. Where a local figure is stricter than the California state baseline, both are shown.

Local ADU rules

Needles's ADU rules are in Zoning Code Section 96.08 (Dwelling Units), last amended by Ordinance 668-AC on November 12, 2024. On a lot that already has a home, ADU and JADU applications are reviewed ministerially, without discretionary review or a hearing, and acted on within 60 days of a complete application; a denial must list what to fix. On a lot without a home, a zoning permit and site plan review are also needed.

Where ADUs are allowed

ADUs are allowed on lots with a proposed or existing home in the R-1, R-2, R-3, CRR and C-2 zones. A converted ADU is built inside an existing single-family home or detached accessory building and may add up to 150 sq ft. ADUs and JADUs do not count toward the lot's density.

Height

A detached ADU may be as tall as the zone allows for main buildings: in R-1, two stories or 35 ft, whichever is less; in R-2 and R-3, three stories or 45 ft, whichever is less; in commercial zones, 45 ft.

Parking

One space per ADU or per bedroom, whichever is less, on top of the main home's parking. It may be uncovered, tandem with the main home's parking or in the front setback, on an improved surface. No space is needed within a half mile of public transit, for an ADU inside the existing home or an existing accessory building, where on-street permits are required but not offered, or within one block of a car share vehicle. State law (Gov. Code § 66322(a)) adds two more: in a historic district, and when the ADU is filed together with a new home or multifamily building. Garage or carport spaces removed for an ADU do not have to be replaced.

Junior ADUs

One JADU is allowed per lot, up to 500 sq ft, inside a single-family home (state law counts an attached garage as part of the home). It needs its own exterior entry and a bathroom of its own or shared with the home through an inside door. A deed restriction must be recorded that bars selling the JADU apart from the home. JADUs pay no impact fees.

Fees, rentals and inspections

ADUs built on a lot with an existing home pay no impact fees. ADUs built with a new home pay none under 750 sq ft and a share in proportion to the home's size at 750 sq ft or more. ADUs may be rented for 30 days or more but not sold apart from the home. Unless the ADU is new construction, a City building inspection at the applicant's cost is required before the permit is issued, and the applicant must show enough sewer or septic capacity. A permit expires after 18 months without a certificate of occupancy. An ADU may get a temporary certificate of occupancy before the main home if a bond is posted and the main home is built within set time limits.

State housing department (HCD) review

On July 22, 2024, HCD found that Needles's ADU ordinance (Ordinance 652-AC) did not comply with state ADU law on 26 points, including 5 ft setbacks, limits on combining ADU types, the vacation rental ban, owner occupancy, zone size rules, missing parking exemptions, junior ADU limits, and tiny home standards. The City had until August 22, 2024 to respond. It adopted Ordinance 668-AC on November 12, 2024, which removed ADU owner occupancy and changed the size and height rules, but several flagged rules remain in the code. Confirm the current rules with the City of Needles.

Fire Hazard Severity Zones

If your lot is in a Fire Hazard Severity Zone, the CAL FIRE Office of the State Fire Marshal says in Information Bulletin 25-004 (issued March 3, 2025): “Fire Hazard Severity Zones (FHSZs) should not restrict the development of Accessory Dwelling Units (ADUs). However, additional building standards may be necessary, including but not limited to California Fire Code Chapter 49 and California Building Code Chapter 7A.” State ADU law does not itself bar an ADU there. A city or county may still apply its building code, including wildfire-resistant construction (Gov. Code 66314(d)(8)); require side and rear setbacks “sufficient for fire and safety” for a unit converted under 66323(a)(1); and decline parking in setbacks on specific fire and life safety findings (66314(d)(10)(B)). It may also consider public safety when it designates where ADUs may be permitted (66314(a)). Sprinklers can't be required in an ADU or JADU if the primary residence doesn't need them (66314(d)(12), 66323(d)). Some cities and counties still apply their own fire-zone limits. Where this summary has one, it is listed with the local rules. This summary does not look up your lot.
