ADU setbacks in Sierra County
Setbacks
New attached and detached ADUs need 4 ft interior side, street side and rear setbacks. The zone's front setback applies unless it would block an ADU of at least 800 sq ft and 16 ft tall with 4 ft side and rear setbacks. No setback for an ADU inside an existing home or accessory structure, or a converted garage (except for fire safety). A detached ADU needs 5 ft from the main home and other structures, or more if the building code requires it.

Local ADU rules
Sierra County's ADU rules are in County Code § 15.10.030, adopted by Ordinance 1133 (in effect January 2, 2025). ADUs are allowed by right in any zone that allows homes, handled ministerially through the building permit, and acted on within 60 days of a complete application.

How many ADUs
On a lot with a single-family home: two ADUs and one JADU, as described in Gov. Code § 66323. On a lot with a multifamily building: up to eight detached ADUs (not more than the number of existing units), plus ADUs converted from non-livable space in the building (up to 25% of the existing units, at least one).

Height
An ADU may be 16 ft. A detached ADU may be 18 ft within a half mile of a major transit stop or high-quality transit corridor (up to 20 ft to match the main home's roof pitch), or on a lot with a multistory multifamily building. An ADU above a detached garage may be 25 ft. An attached ADU may reach the zone's height limit.

Parking
One off-street, all-weather space per ADU or per bedroom, whichever is less, which may be covered or uncovered, tandem or in setback areas. None is needed within a half mile of public transit, on a historically significant property, for an ADU inside the home or an existing accessory structure, where on-street permits are required but not offered, within one block of a car share vehicle, or when the ADU is filed with a new home. Garage or carport spaces removed for an ADU need not be replaced. JADUs need no parking.

Privacy and entrance
An ADU needs its own exterior entrance. Where an ADU sits outside the main home's setbacks and faces a neighbor, one privacy measure is required: high (clerestory) windows, obscured glass, or at least 18 in. of lattice on a 6 ft fence along the shared line.

Junior ADUs
One JADU of up to 500 sq ft, entirely inside the walls of an existing or proposed single-family home, with an efficiency kitchen and its own exterior entrance. The bathroom may be shared, with an interior door to the home. A deed restriction is recorded before occupancy.

No impact fees for an ADU under 750 sq ft; larger ADUs pay in proportion to the main home. No new utility connection or connection fee unless the ADU is built with a new home or sold separately. Fire sprinklers only if the main home needs them. ADUs may not be sold separately (except as Gov. Code § 66341 allows) and may not be rented for less than 30 days.

Fire Hazard Severity Zones
If your lot is in a Fire Hazard Severity Zone, the CAL FIRE Office of the State Fire Marshal says in Information Bulletin 25-004 (issued March 3, 2025): “Fire Hazard Severity Zones (FHSZs) should not restrict the development of Accessory Dwelling Units (ADUs). However, additional building standards may be necessary, including but not limited to California Fire Code Chapter 49 and California Building Code Chapter 7A.” State ADU law does not itself bar an ADU there. A city or county may still apply its building code, including wildfire-resistant construction (Gov. Code 66314(d)(8)); require side and rear setbacks “sufficient for fire and safety” for a unit converted under 66323(a)(1); and decline parking in setbacks on specific fire and life safety findings (66314(d)(10)(B)). It may also consider public safety when it designates where ADUs may be permitted (66314(a)). Sprinklers can't be required in an ADU or JADU if the primary residence doesn't need them (66314(d)(12), 66323(d)). Some cities and counties still apply their own fire-zone limits. Where this summary has one, it is listed with the local rules. This summary does not look up your lot.
